Judge Tosses Defamation Claim Against Napoli Lawyers

In a move that made headlines in several prestigious law journals, a Rhode Island federal judge dismissed a lawsuit against “top lawyers Marie Napoli and Paul Napoli,” citing a complete lack of jurisdiction to hear the claims alleged against them.

U.S. District Judge William Smith not only dismissed most of the underlying claims, but also ordered the remainder of the action transferred to another court. Judge Smith essentially concluded that the plaintiff’s unsubstantiated claims against Napoli Shkolnik PLLC and its predecessor firm were entirely without merit.

The remainder of the action will now move to a Manhattan federal court, where Paul Napoli expects that “we [will] win our motion 100 percent just as we did in Rhode Island.” Marie Napoli added that she was relieved to have this action behind her, so that they can continue to focus on moving their firm’s cases forward and obtaining results for their clients.
