In a move that made headlines in several prestigious law journals, a Rhode Island federal judge dismissed a lawsuit against “top lawyers Marie Napoli and Paul Napoli,” citing a complete lack of jurisdiction to hear the claims alleged against them.
U.S. District Judge William Smith not only dismissed most of the underlying claims, but also ordered the remainder of the action transferred to another court. Judge Smith essentially concluded that the plaintiff’s unsubstantiated claims against Napoli Shkolnik PLLC and its predecessor firm were entirely without merit.
The remainder of the action will now move to a Manhattan federal court, where Paul Napoli expects that “we [will] win our motion 100 percent just as we did in Rhode Island.” Marie Napoli added that she was relieved to have this action behind her, so that they can continue to focus on moving their firm’s cases forward and obtaining results for their clients.
Napoli Shkolnik PLLC Practice Areas
At the New York City-based firm, Paul and Marie, the partners, and attorneys represent clients in environmental tort cases, such as PFOA and other drinking water contamination cases, as well as 9/11 injury compensation. Marie Napoli is also heavily involved in personal injury and defective medical device litigation, having been recently named to the plaintiff’s steering committee in the ongoing Birmingham Hip Resurfacing (BHR) case in a Maryland federal court. As she points out, “People believe they are being given a hip replacement that will solve their problem, eliminate their pain, and allow them to remain highly physically active, but then end up with the exact opposite situation—chronic pain, no mobility, infections, and even additional surgeries. My firm and I believe that those responsible for our client’s suffering should be held accountable and we are ready to take on that fight.”
Working together, along with the other attorneys and legal professionals, Napoli Shkolnik PLLC has notched some significant victories in recent months, including:
• A favorable ruling on a nationwide class action driver lawsuit against rideshare giant Uber in a North Carolina court;
• Pending actions against prescription painkiller manufacturers related to the opioid overdose epidemic in many New York Counties; and
• A lawsuit against the Port Authority of New York and other government agencies, alleging they are responsible for PFOS drinking water contamination in Newburgh, NY.
Other areas of practice at Napoli Shkolnik PLLC, which is peer recognized in the industry due to its nationwide reach and proven record of success include personal injury, asbestos/mesothelioma, and large transportation accidents, such as airplane crashes.
