NorthStar Legal Action Group, PC, Napoli Shkolnik PLLC, and actor and activist Hill Harper have filed a motion for a preliminary injunction and temporary restraining order against the State of Michigan, seeking to compel the State to continue providing bottled water at the remaining four Point of Distribution (POD) sites.
Recently, the State of Michigan announced that all PODs in the City of Flint will be permanently closed, leaving residents to reach into their own pockets to pay for bottled water. The State’s decision to close the PODs was made despite recent testing reports by the State of Michigan collected from January 1, 2018 through April 2, 2018 showing test results exceeding the Environmental Protection Agency’s (EPA) action level of 15 parts per billion (ppb). The results at Plaintiff Allen Bryant Jr.’s Flint home were the highest, measured at 1300 ppb, nearly 87 times the EPA action level. The State’s report also showed that at least 13 other residential properties in Flint have unsafe levels of lead in their tap water. Despite their own evidence of a continuing public health crisis, the State has decided to take bottled water away from Flint’s residents, a decision that has been met with public backlash.
The approximate cost associated with providing bottled water to Flint’s residences is $22,000, a mere .0001% of the State’s budget for the fiscal year. Moreover, the motion comes on the eve of the four-year anniversary of the switch to the Flint River as Flint’s primary source of water. Plaintiffs are asking for temporary restraining order effective for ten (10) days compelling continuation of the bottle water program until a hearing before a federal judge can be heard on the requested Preliminary Injunction. The motion alleges that “the State’s claim that they are now in compliance with the Lead and Copper Rule does not take into consideration the poorest neighborhoods of Flint who still have elevated levels of lead in their water supply. This conscious disregard of the health and welfare of the poorest members of the Flint community is consistent with the findings of the Flint Water Advisory Task Force, as the State continues to engage in environmental racism.
