NY Law Journal: Paul Napoli on Billion Dollar Opioid Deal

The legislatures of Nassau County and Suffolk County will have the opportunity to formally approve Tuesday’s settlement in August. The agreement would send $86 million to Nassau County and $106 million to Suffolk County. Paul Napoli of Napoli Shkolnik, who represents Nassau County, said that the New York settlement is “the impetus and the driving force” behind the $21 billion global settlement that will soon be announced, according to multiple reports, with McKesson, Cardinal Health, and AmerisourceBergen. “Without Judge Garguilo setting the case for trial and the trial lawyers and the AG trying this case, there certainly would not have been a New York settlement and probably would not be a global settlement for quite some time,” Napoli said. “So New York did benefit not only New York but the rest of the country in bringing this chapter to a conclusion with the distributors.” Napoli said the possibility of more settlements with the remaining defendants exists, but he and his colleagues are doubtful on that point. “These defendants have dug in trying to justify their conduct to the jury and to the court, and I think they’re blinded by their own greed and have not taken responsibility,” he said.
