Plaintiff, a union electrician, fell on a job-site while working with a crew to pull wiring through a metal conduit with a torn and frayed rope which broke. Plaintiff had complained about the rope being unsafe but no replacement rope was provided, nor was an available “wire puller” put into use.  Plaintiff sustained neck and back injuries that were treated conservatively without the need for surgery. A settlement  was obtained by direct negotiations with the general contractor while a motion for dismissal/summary judgment was pending. We were also able to obtain a reduction of the workers compensation lien.
