Stephen J. Maloney, Jr. is a seasoned New York trial attorney who represents individuals, families, and communities in high-stakes personal injury, medical malpractice, wrongful death, and environmental litigation. A skilled advocate both in and out of the courtroom, he has built a reputation for securing significant verdicts and settlements on behalf of those harmed by negligence while guiding clients through some of life’s most difficult challenges with compassion and unwavering dedication.

Maloney’s practice comes through referrals from former clients, attorneys, and other professionals – a testament to the trust he has earned throughout his career. He has successfully tried and resolved cases involving catastrophic injuries, medical malpractice, labor law and construction accidents, premises liability, nursing home negligence, motor vehicle collisions, sexual assault, and other complex negligence claims. His notable results include an $8 million jury verdict against the City of Yonkers on behalf of a client seriously injured in a collision with a municipal vehicle after rejecting a pre-trial offer of just $35,000; a $2.75 million jury verdict for a hotel guest who was sexually assaulted after the property negligently permitted an unlicensed individual access to her room; and a $3.5 million settlement for a pedestrian struck by a municipal truck who sustained multiple fractures, severe burns, and psychological trauma. Whether presenting a case to a jury or negotiating a resolution, Steve combines meticulous preparation, strategic advocacy, and courtroom experience to pursue the best possible outcome for every client.

Maloney also plays an important role in the firm’s environmental litigation practice, applying his trial experience to matters involving corporate accountability and public health. He is part of the team representing the Village of Endicott in its lawsuit against IBM arising from alleged PFAS and 1,4-Dioxane contamination of the municipal drinking water supply. The litigation successfully overcame significant early legal challenges, allowing key environmental claims to proceed toward discovery and advancing the community’s efforts to recover the costs of environmental remediation.

Before joining Napoli Shkolnik, Steve spent years representing hospitals, physicians, insurance carriers, and major corporations at one of Long Island’s leading defense firms. He also served as a Senior Trial Attorney for Allstate Insurance Company. This defense background provides him with a distinct strategic advantage, offering firsthand insight into how insurers evaluate, defend, and value claims—knowledge he now leverages to maximize results for injured clients.

Steve has been recognized among The National Trial Lawyers Top 40 Under 40 Civil Plaintiff Attorneys and has been continuously selected to the New York Metro Super Lawyers® Rising Stars list beginning in 2020 through 2026. These recognitions reflect the respect he has earned among his peers and his growing reputation as a leading plaintiffs’ trial attorney.

He earned his Juris Doctor from Albany Law School, where he participated in the school’s Litigation Clinic and represented clients throughout New York’s Capital District under a student practice order issued by the Appellate Division. Steve also gained legislative experience while working in the New York State Senate.

$1,375,000 Pedestrian Knockdown Settlement

The firm secured a $1,375,000 settlement just before jury selection. Our client, a 37-year-old chef was on her way to work when she was struck by a municipal truck at 34th Street and Lexington Avenue, suffering a concussion, shoulder injuries requiring surgery, and neck and back herniations. 

$3,500,000 Pedestrian Knockdown Settlement

Secured a $3.5 million settlement for a pedestrian who was struck by a municipal truck while walking her dog. She suffered multiple leg fractures, second-degree burns, and post-traumatic stress disorder. Despite the defense arguing that she had made a full recovery because she did not require surgery, the case resolved with a significant settlement.

$600,000 Workplace Injury Settlement

The firm secured a $600,000 settlement after our 21-year-old client was violently assaulted inside a restaurant, suffering a fractured nose, head injury, and PTSD. $405,000 Product Liability Settlement

The firm secured a $405,000 settlement by demonstrating defective design and negligent customer guidance, after our client suffered severe hand injuries requiring emergency surgery, while troubleshooting his electric pool heater, when the heater’s fan suddenly turned on and broke apart. The defendant tried to blame him, we proved otherwise by demonstrating defective design and negligent customer guidance.

$750,000 Workplace Injury Settlement

The firm secured a $750,000 settlement at mediation on behalf of our client, who fell from a neglected concrete platform and suffered a severe brain bleed that required a craniotomy, along with shoulder surgery. Along with a significant reduction in the Plaintiff’s Workers’ Compensation lien, bringing meaningful relief after extensive injuries.

$300,000 Slip-and-Fall Settlement

The $300,000 settlement was achieved for our client, who slipped on a wet floor, sustaining a wrist fracture that required surgery. Highlighting the need for proper safety measures in venues where gatherings take place.

An $850,000 settlement was reached a few weeks before trial on behalf of our client, who tripped on a raised piece of plywood and fell, suffering severe injuries.

$8,000,000 Trial Verdict against the City of Yonkers, NY

This multi-million dollar verdict was achieved for our client after a car accident involving a city employee left our client with serious injuries to the lumbar spine, cervical spine, left knee, and left shoulder. The pre-trial offer was $35,000.

$4,500,000 Private Mediation Construction Settlement
Our client, a 46-year-old union electrician worker, was in the process of installing fiber optic cables in a cement vault six feet underground in a manhole when an electric wet-dry vacuum (filled with approximately fifteen gallons of water) rolled towards the uncovered manhole and fell on our client’s head and neck.

We obtained summary judgment as to liability under Labor Law §240(1).  The client sustained numerous severe and permanent lumbar and cervical injuries that eventually required a lumbar fusion, cervical fusion, and cervical fusion revision.

Due to the injuries sustained, the client has been unable to return to work as an electrician.

$2,800,000 Construction Site Settlement
This settlement was reached during a three-week trial in New York County Supreme Court. A freight elevator closed on our client, a site supervisor at a construction site, causing back injuries that required a lumbar fusion.

$2,750,000 Sexual Assault Verdict 
The Defendant hotel arranged for an outside individual, who was unregistered and unlicensed to perform massage therapy in New York, to go to our client’s room, where she was assaulted. The Defendant’s final offer was only $150,000. Our client suffered significant harm from this incident, requiring ongoing care and treatment, and we are proud to bring her justice and the compensation she deserved.

$2,377,905 Trial Verdict in Supreme Court, Nassau County
Our client was rear-ended while driving her daughter home with her daughter.  The client sustained shoulder tears requiring arthroscopic surgery and herniated discs in the cervical spine that necessitated epidural steroid injections. We obtained Summary Judgment on liability and proceeded with a trial on damages. The defendants’ final pre-trial offer was $50,000.

$1,500,000 Global Settlement
This settlement was reached for two clients, who were crossing the street in Queens, NY, when a commercial truck made a right turn and knocked them both to the ground. Both clients sustained serious shoulder and neck injuries, requiring surgical intervention. The defendants had argued that our clients were not in a designated crosswalk and were negligently walking in front of the defendant’s truck.

$1,500,000 Auto Settlement 
This settlement was reached after jury selection during a damages trial in New York County Supreme Court. This was a rear-end accident that caused serious neck injuries for our client.

$1,200,000 Auto Settlement
Our clients (husband and wife) were rear-ended on the Saw Mill River Parkway in Yonkers, New York.  Both clients sustained numerous injuries to their shoulders and neck, requiring numerous injections and surgical procedures. The matter settled prior to the depositions being held.

$1,000,000 Brain Injury Settlement
This result was achieved at a settlement conference in the Eastern District of New York.  Our client slipped and fell on a liquid substance at a commercial property, striking his head and suffering a traumatic brain injury.

$1,000,000 Private Mediation
Our client was employed as a diving superintendent working on a project in the Hudson River, replacing underwater cable conduits.  While disembarking from the main deck of the co-defendant’s barge to the co-defendant’s tugboat that was hired to transport workers to and from land, our client slipped and fell into the water.  He sustained numerous tears to his shoulder and knee, both requiring extensive surgical intervention.  Our client was forced to retire as he was unable to return to work due to the injuries sustained.  We asserted causes of actions against both owners of the barge and tugboat, which included Violation of “The Jones Act”, Vessel Negligence Under 33 U.S.C 905(b) and 33 U.S.C. 933, Negligence and Breach of the Duties Imposed by The General Maritime Law and Common Law Negligence.  The parties settled the matter at a private mediation for $1,000,000, which also included the defendants fully satisfying our client’s Workers’ Compensation lien.

$1,000,000 Private Mediation
Our client, an experienced factory worker, was using a hot stamping machine during the course of his employment when the machine malfunctioned and abruptly descended onto his hands.  The malfunction trapped and crushed his hands, causing him to sustain third-degree burns and broken bones.  The burns and injuries necessitated a skin harvesting procedure where a tangential excision and split-thickness autograft were taken from the right thigh to the bilateral hands.

$750,000 Private Mediation
Our client was traveling on Willets Point Boulevard in Queens, New York, when the defendant’s vehicle ran the stop sign at 15th Drive, violently striking the driver’s side of our client’s vehicle.  The client underwent a cervical discectomy and fusion and a lumbar discectomy for the numerous neck and back injuries sustained in the accident.  After we obtained Summary Judgment on liability, the matter settled for $750,000 at a private mediation.

$750,000 Pedestrian Knockdown Settlement
The settlement was reached after a pedestrian knockdown that occurred in Mount Kisco, NY. Our client sustained an ankle fracture and back injuries, which required a lumbar discectomy.

$500,000 Auto Accident Settlement
This settlement was secured after the insurance company initially offered $6000.

$500,000 Private Mediation
Our client was driving for Uber and was stopped in a parking lane on Old Northern Boulevard in Roslyn, NY, when the defendant’s vehicle was exiting a restaurant parking lot across the street.  The defendant failed to see our vehicle while turning onto Old Northern Boulevard, smashing into the driver’s side, which resulted in our car being totaled.  The client underwent left shoulder surgery and cervical discectomy as a result of the injuries sustained in the accident.

$450,000 Private Mediation Settlement
Our client was traveling on the Major Deegan Expressway when she was rear-ended by a commercial delivery van. She suffered from back and knee injuries, both requiring surgical intervention.

$425,00 Medical Malpractice Settlement
This settlement was achieved after jury selection in the Supreme Court, Nassau County. Our client developed a hematoma involving the left iliacus and iliopsoas muscles, femoral neuropathy, and femoral nerve damage as a result of the defendant’s failure to monitor the client’s INR levels after an unrelated surgical procedure.

$400,000 Private Mediation
Our client arrived at her office building in the morning when she slipped and fell on a puddle of water in the main lobby.  Our client sustained an avulsion fracture of her right foot, numerous herniated discs, and right shoulder tears that required two surgical procedures.  During the course of discovery and party depositions, we were able to uncover that the employees of the building failed to take the necessary safety actions and precautions regarding the lobby and wet floor on the day of our client’s fall.  Furthermore, the defendants were in violation of numerous sections in the International Building Code and International Maintenance Code.

$300,000 Slip and Fall Settlement
Our client tripped and fell on a defect in the middle of the street while walking her dog.  The City of NY moved for summary judgment, alleging that it had no prior notice of the defect. We were able to defeat the motion while proving that the City did, in fact, have notice of the subject matter defect.  Our client sustained a fractured ankle as a result of her fall. The matter settled for $300,000 prior to the matter being placed on the trial calendar.

$250,000 Private Mediation
Our clients were stopped at a red light when a commercial truck improperly reversed, striking the front of our clients’ vehicle.  Both sustained soft tissue injuries to their cervical and lumbar spines.

$250,000 Settlement
Our client was parked in his vehicle on the side of the road when a school bus being operated under contract through the City of NY struck our client’s vehicle in the rear. Our client suffered significant damage to his shoulder, neck, and back, eventually requiring shoulder surgery. We had been granted summary judgment on liability and were able to settle the matter prior to mediation or the matter being put on the trial calendar.

$225,000 Mediation Settlement
Our client was traveling on The Queens Midtown Expressway near Maurice Avenue when the defendant’s vehicle ran the red light at Maurice Avenue while attempting to turn onto the Queens Midtown Expressway, striking our client’s vehicle and rending him unconscious. Our client suffered numerous cervical herniated discs as well as a left shoulder labral tear that required arthroscopic surgery. The matter settled for $225,000 at a private mediation before the matter was even on the trial calendar.

$215,000 Trial Settlement
This trial settlement was negotiated in the Supreme & County Courts of Westchester County. Our elderly client was dropped off by an ambulette driver, causing our client to suffer a fractured ankle.

$160,000 Settlement at Trial
Our client was working as a physical therapist at a nursing home facility when she suffered from an electric shock while attempting to remove a laptop charger from an outlet, both of which were owned and controlled by the defendant. The defendants had a no-pay position throughout the entirety of the litigation, and the matter eventually went to trial in the U.S. District Court, Southern District of New York.
