N.C. car dealership sues Carvana, says online dealer doesn’t follow the rules

Napoli Shkolnik has filed a federal lawsuit, which may become a class action, in the Western District of North Carolina, Statesville Division against online car dealership Carvana.

The lawsuit states, “Carvana portrays a vast catalog of options with the availability of the exact model the consumer wants. Carvana deceptively does this since it advertises it has units available within a specific country or area—such as Hickory—where it does not have a licensed dealership.”

North Carolina-based Napoli Shkolnik attorney Nevin Wisnoski has shared, “Legitimate used-car dealers in North Carolina and across the country have suffered direct financial and competitive harm due to an inability to lawfully compete with Carvana’s illicitly obtained market advantages—which hurt both market competitors and the broader consuming public.”
