Class Action Lawsuit Filed Alleging Labor Law Violations

Quest Diagnostics Class Action

Napoli Shkolnik filed a class action lawsuit in the Supreme Court of New York, New York County on behalf of lead plaintiff Maria Vecchio and on behalf of all others similarly situated, against Quest Diagnostics Inc., ExamOne World Wide Inc., and ExamOne LLC.  Our firm is also seeking to represent other current and former Mobile Examiners who worked for Quest and affiliated Quest entities within New York state and in other states. Our lawsuit alleges the following violations:

  • not paying New York minimum wage;
  • not reimbursing business expenses;
  • not paying overtime wages;
  • not paying spread of hours pay; and
  • not providing employees proper wage statements.

Ms. Vecchio and her attorneys believe that Quest and its subsidiaries have violated the above state laws. She is possibly one of thousands of New York employees who work or worked for Quest as Mobile Examiners and were not paid in accordance with state law. This action against Exam One is presented as a class action (Index Number 652069/2019) on behalf of herself and all similarly affected individuals for violations of the state labor law.

If you work or have worked for Quest as a Mobile Examiner within the past 6 years, and you believe your rights were violated as described above or in any other way, we encourage you to please call us at (212) 397-1000.

Employment Laws, also known as Labor Standards can be complex and vary by county, city and state so it is important to have an experienced and knowledgeable Napoli Shkolnik attorney handling your case. For instance, the New York State minimum wage was recently increased in December 2018. However, the per hour rate differs in New York City, Nassau, Suffolk and Westchester counties by the number of employees. Additionally, there are different hourly rates in the fast food industry and for those who receive tips. It is important to know your rights when it comes to wage and hour laws.

Labor and employment laws encompass many areas of law including Employment Discrimination & Harassment, Wrongful Termination, Benefits Administration, Privacy & Employee Rights, and more. Unfortunately it can become necessary to have a skilled attorney on your side, fighting for your rights. If you believe that any of your employee rights have been violated, like Ms. Vecchio does, give Napoli Shkolnik a call. We will provide a free, confidential consultation and there is no obligation to move forward. However, you will now have the legal options in front of you and can decide whether or not you would like to pursue a case. Remember, we work on a contingency basis, which means we do not collect a fee unless we win your case.

A common question that is asked as to do with “Exempt” versus “Nonexempt” Employees. Essentially the important distinction is that exempt employees are not eligible to earn overtime for extra hours worked while nonexempt employees can. There are certain “exemptions” set by the federal Fair Labor Standards Act (FLSA). Have you not been receiving fair compensation? Call and speak with a Napoli Shkolnik representative for free legal analysis of your circumstances. Keep in mind that Wage and Hour Laws, again, vary by state.
