$1,000,000 Private Mediation

Our client was employed as a diving superintendent working on a project in the Hudson River replacing underwater cable conduits. While disembarking from the main deck of the co-defendant’s barge to co-defendant’s tugboat that was hired to transport workers to and from land, our client slipped and fell into the water. He sustained numerous tears to his shoulder and knee, both requiring extensive surgical intervention. Our client was forced to retire as he was unable to return to work due to the injuries sustained. We asserted causes of actions against both owners of the barge and tugboat, that included Violation of “The Jones Act”, Vessel Negligence Under 33 U.S.C 905(b) and 33 U.S.C. 933, Negligence and Breach of the Duties Imposed by The General Maritime Law and Common Law Negligence. The parties settled the matter at a private mediation for $1,000,000, which also included the defendants fully satisfying our client’s Workers’ Compensation lien.
