Social Security Disability Attorneys

Should I hire a New York Social Security Disability lawyer?

Statistically speaking, the majority of Social Security Disability Insurance (SSDI) claims are initially denied. The Social Security Administration's own website reports that, of the 2.9 million claims filed in 2011, less than two-thirds were approved at the initial claim level. These claims must then be submitted for reconsideration, which means that another person at the agency will conduct a new, complete review of the application to determine whether it should be approved. The majority of reconsideration level claims are also denied. This leaves SSDI applicants facing the next step in the process, a hearing before an Administrative Law Judge (ALJ) who works for the Social Security Administration. In addition to providing much-needed representation at the hearing level of a Social Security Disability claim, an attorney can help a disabled worker file an initial application to potentially avoid this hearing in the first place. Filing an application for disability benefits can be complicated. It is also time-consuming and requires some effort, which can quickly exhaust a disabled worker's limited resources. All pertinent identifying information must be included (Social Security number, birth certificate, etc.) as well as work information (work history, W-2) and medical information (medical records, test results and documentation). The application must be filed properly and must include all necessary information and supporting documentation, or it may be denied or delayed. An attorney can help file the claim to ensure everything is done at this level to get it approved. When an SSDI application has already been filed and denied, and a request for reconsideration has proven unsuccessful, an attorney can help prepare for the administrative hearing. An attorney an also present the applicant's case at this hearing to give the Judge clear, compelling evidence as to why the claim should be approved. A skilled Social Security Disability attorney will know what information is needed by the Judge to make a favorable decision and how to present this information in the applicant's favor. Depending on the outcome of this hearing, an attorney can then file an appeal with the Social Security Administration Appeals Council. There are multiple levels at which an applicant can appeal a denied disability claim. A legal professional who has experience with these matters will know how to best approach the next step in order to give the applicant the best chance at a successful result. It is important to note that you are not required to hire an attorney when filing for Social Security Disability benefits. You may find, however, that you can achieve peace of mind and a more successful result with a skilled professional by your side.
