Napoli Shkolnik Junior Partner Stephen J. Maloney, Jr. spoke to People on the condition of his client, Nicholas Russo, who suffered catastrophic brain injuries while playing a recreational softball game at a Town of Smithtown-owned field. Nicholas’ foot slipped and became wedged in a gap between two bases that were not connected, causing his leg to hyperextend and twist before he fell and struck his head on the turf field.  

“It really just comes down to taking it day by day and seeing how he improves and how his body responds,” Maloney told People. “We all wish we had a clearer answer or outlook, but we just don’t know. It’s going to take time.” 

Napoli Shkolnik remains committed to pursuing accountability for the Russo family while advocating for those whose lives have been forever changed by preventable injuries. 

“If you keep a positive mindset, you can achieve anything,” Nicholas told People via iPad translation.
