{"id":17357,"date":"2024-03-29T17:24:12","date_gmt":"2024-03-29T21:24:12","guid":{"rendered":"https:\/\/www.napolilaw.com\/?post_type=whitepapers&#038;p=17357"},"modified":"2024-03-29T17:24:13","modified_gmt":"2024-03-29T21:24:13","slug":"opioid-litigation-goes-to-ohio-supreme-court","status":"publish","type":"whitepapers","link":"https:\/\/www.napolilaw.com\/whitepapers\/opioid-litigation-goes-to-ohio-supreme-court\/","title":{"rendered":"Opioid Litigation Goes to Ohio Supreme Court"},"content":{"rendered":"\n<p>The Ohio Supreme Court on Tuesday will become only the second state high court to hear oral arguments on whether the opioid epidemic is a public nuisance, the controversial legal theory underpinning numerous suits across the country including a $650 million award that two Ohio counties won against Walmart, CVS and Walgreens.<\/p>\n\n\n\n<p>&#8220;I think both sides felt the law is clear,&#8221; said <a href=\"https:\/\/nsprlaw.com\/en\/attorneys\/hunter-j-shkolnik\/\" target=\"_blank\" rel=\"noopener\">Hunter Shkolnik<\/a> of Napoli Shkolnik, one of the plaintiffs attorneys in the litigation, referring to the Ohio Product Liability Law.<\/p>\n\n\n\n<p>&#8220;We felt that our interpretation was right. They thought their interpretation was right. And the one thing we both agreed was we didn&#8217;t think it was an open question of law,&#8221; he added. But obviously, the circuit and then the <a href=\"https:\/\/www.napolilaw.com\/article\/napoli-shkolnik-applauds-u-s-supreme-court-decision-to-reject-liability-shield-at-center-of-purdue-pharma-settlement\/\" data-wpil-monitor-id=\"25\">Supreme Court<\/a> by accepting felt there is something that has to be clarified in the law, on whether or not public nuisance was subsumed or not in the statute.
