That included sedating a patient and extracting a tooth while he rode a Hoverboard. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">He then sent the video to several people, declaring that he had established \u201ca new standard of care.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The patient said she did not consent to being filmed and it was \u201cunprofessional\u201d and \u201ccrazy\u201d to perform the procedure in that way. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Through his attorney, Dr. Lookhart apologized to the patient, who did not know about the video until investigators reached out to her.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The court also convicted Dr. Lookhart of Medicaid fraud. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Judge Wolverton was incensed that Dr. Lookhart \u201cbelieved that he could get away with his fraud indefinitely, and that he believed his scheme was foolproof.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The financial and medical malpractice evidence \u201cwas often supported, and often in excruciating detail, by Lookhart&#8217;s own texts, photos and videos,\u201d the judge added.<\/span><\/p>\n<h2><b>Standard of Care in Medical Negligence Claims<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">When they are behind the wheel, most drivers have a duty of reasonable care. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">They must drive defensively and obey the rules of the road. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Furthermore, the same standard of care usually applies to all drivers. Some basic elements of this fiduciary duty include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Awareness of current best care practices,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Maintaining a high level of professional competence,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Effectively communicating with patients,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Being accountable to their patients and\/or to other professionals,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Self-review and self-reflection,<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">A demonstrable track record of successful care, and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Completing continuing education requirements.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">This duty also includes a responsibility to disregard everything else and focus solely on what is best for the patient. Making money and enhancing one\u2019s reputation are secondary to patient care.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Generally, all doctors must adhere to the same standard of care.
