On October 2nd, 2025, Russo was playing at Indian Head field in Flynn Memorial Park when his left foot became caught between two separated, unsecured bases at first base. He stumbled, rolled his ankle, hyperextended his leg, and fell forward onto the turf. He struck his head and suffered traumatic brain injuries requiring an emergency procedure to remove part of his skull. Russo was in a coma for a month, and he is now staying at a rehabilitation center.

The lawsuit, filed by his wife, Paige Russo, alleges that the Town of Smithtown failed to conduct proper maintenance on the field and allowed the first base area and surrounding turf to become defective and dangerous.

"Our position is that they used the wrong equipment and the wrong bases, and in doing so, they created this trap, this hidden danger that caused him to fall," said Stephen J. Maloney, Napoli Shkolnik Junior Partner representing the Russos.

The case is ongoing in Suffolk County Supreme Court.
