{"id":2482,"date":"2018-06-21T15:46:36","date_gmt":"2018-06-21T19:46:36","guid":{"rendered":"http:\/\/localhost:10028\/whitepapers\/ny-law-journal-quotes-paul-napoli-on-opioid-ruling\/"},"modified":"2022-06-27T02:27:24","modified_gmt":"2022-06-27T06:27:24","slug":"ny-law-journal-quotes-paul-napoli-on-opioid-ruling","status":"publish","type":"whitepapers","link":"https:\/\/www.napolilaw.com\/whitepapers\/ny-law-journal-quotes-paul-napoli-on-opioid-ruling\/","title":{"rendered":"NY Law Journal Quotes Paul Napoli on Opioid Ruling"},"content":{"rendered":"<p>A New York state court judge has refused to dismiss lawsuits against several opioid manufacturers\u00a0in some of the first substantive rulings to come out of the barrage of cases brought by governments over the <a href=\"\/office-of-governmental-affairs-opioid-lawyers\/\">prescription painkillers<\/a>.<\/p>\n<p>In a pair of rulings on Monday, Suffolk County Supreme Court Judge Jerry Garguilo rejected motions to dismiss brought by Purdue Pharma, Endo Health Solutions, Teva Pharmaceuticals, Allergan, Johnson &amp; Johnson\u2019s Janssen Pharmaceuticals Inc. and Insys Therapeutics Inc. He allowed cases brought by New York counties to go forward alleging violations of New York\u2019s consumer fraud and false advertising laws, as well as public nuisance, negligence, fraud and other claims.<\/p>\n<p>\u201cThis is foreshadowing of more to come, frankly, from the MDL,\u201d said <a href=\"\/napoli-attorney\/paul-napoli\/\">Paul Napoli<\/a>, of counsel at New York\u2019s Napoli Shkolnik and <a href=\"\/article\/paul-napoli-appointed-leadership-role-opioid-litigation\/\">co-lead plaintiffs counsel<\/a> in the New York cases. \u201cThere\u2019s certainly overlap in theories and arguments at both levels.
