A Snap spokesperson insisted that the social media company denies that the lenses violate BIPA, noting that lenses don\u2019t collect biometric data that can be used to identify a specific person.<\/p>\n\n\n\n<p>Other recent BIPA violation class action privacy lawsuit settlements include $92 million against TikTok, $100 million against Google, and a massive $650 million settlement against Facebook.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Biometric Data, BIPA, and Privacy Laws<strong><\/strong><\/h2>\n\n\n\n<p>Google, Meta, and other large tech companies repeatedly say that they respect your privacy. That may be true, but they certainly don\u2019t protect it.<\/p>\n\n\n\n<p>Personal information is big business. Many companies are willing to pay a lot of money for biometric data (also called behaviometrics), like facial recognition, typing pattern, and mouse movement. Many countries, including the United States, also collect such information. In all, by 2025, biometric data for <a href=\"https:\/\/www.dhs.gov\/biometrics\" target=\"_blank\" rel=\"noopener\">over four billion people<\/a> will be available to public and private sector entities.<\/p>\n\n\n\n<p>The 2008 Biometric Information Privacy Act is widely regarded as one of the most comprehensive behaviometrics laws in the world. It forbids public or private entities from gathering such information unless the entity informs individuals in writing and these individuals consent in writing.&nbsp;Additionally, BIPA contains a private right of action.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Biometric Data Hacking<\/h2>\n\n\n\n<p>Illegal biometric data harvesting is widespread. However, arguably more serious issues involve data breaches and HIPAA violations.<\/p>\n\n\n\n<p>Bank website and app security are almost impossible to breach, but for anyone with experience and patience, most other websites are relatively easy to penetrate. Making matters more difficult, many hackers aren\u2019t after money. \u201cHackitivists\u201d want to make a statement. Others want to penetrate online security just to prove to themselves that they can do it.<\/p>\n\n\n\n<p>That\u2019s especially true in the Work From Home (WFH) era. It also included protection for PII (personal identifying information), such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Drivers\u2019 license number,<\/li><li>Home address,<\/li><li>Telephone number,<\/li><li>Date of birth,<\/li><li>Credit card information, and<\/li><li>Bank account information.<\/li><\/ul>\n\n\n\n<p>Many companies routinely collect and store such information, especially non-financial data. If these companies don\u2019t carefully protect this information, they\u2019re liable for substantial damages.
