That means that, with few exceptions, a worker\u2019s injuries are covered regardless of who caused the accident that led to them. Still, employers have a specific procedure they must follow when an employee&#8217;s injury is reported to them. If an employer fails to follow the workplace injury procedure, they may be fined.<\/span><\/p>\n<h3><b><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-13767 size-large\" src=\"\/wp-content\/uploads\/2022\/08\/accident-clain-1024x683-1.jpg\" alt=\"A worker filling accident claim form\" width=\"900\" height=\"600\" \/><\/b><\/h3>\n<p>&nbsp;<\/p>\n<h3><b>What are an employer\u2019s responsibilities?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Employer\u2019s responsibilities can be divided into 3 segments:<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4><b>BEFORE an injury occurs: <\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Employers have a duty to provide a safe working environment for the employees<\/span><b>, <\/b><span style=\"font-weight: 400;\">to prevent workplace accidents.<\/span> <span style=\"font-weight: 400;\">Each work environment varies, for example, there will be different safety protocols in an office versus a <\/span><a href=\"https:\/\/www.osha.gov\/sites\/default\/files\/publications\/OSHA3404laboratory-safety-guidance.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">laboratory<\/span><\/a><span style=\"font-weight: 400;\"> or <\/span><a href=\"https:\/\/www.osha.gov\/construction\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">construction site<\/span><\/a><span style=\"font-weight: 400;\">. Employers must adhere to local, state, and federal safety guidelines and those who fail to meet these obligations may face penalties from the <\/span><a href=\"https:\/\/www.osha.gov\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Occupational Safety and Health Administration<\/span><\/a><span style=\"font-weight: 400;\"> (OSHA) when an injury occurs. Employers should also make sure that their workers\u2019 compensation insurance is current.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4><b>When an injury occurs<\/b><span style=\"font-weight: 400;\">, employers\u2019 workplace injury procedure requires them to:<\/span><\/h4>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Report the injury to the Workers\u2019 Compensation Board within 10 days of the injury if the worker needs medical treatment beyond first aid and misses at least one day of work;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Report any changes in the worker\u2019s pay or work status, due to the injury;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Report the worker\u2019s salary to determine their Average Weekly Wage; and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Record the injury and keep that record on file for <\/span><a href=\"https:\/\/www.osha.gov\/recordkeeping\/#:~:text=The%20records%20must%20be%20maintained,illnesses%20recorded%20the%20previous%20year\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">5 years<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4><b>AFTER an injury occurs: <\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Employers are required to provide employees with alternate duties while they recover.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>What are employers NOT allowed to do?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In addition to following the correct workplace injury procedure, employers are <\/span><span style=\"font-weight: 400;\">not<\/span><span style=\"font-weight: 400;\"> allowed to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prevent employees from filing a worker&#8217;s compensation claim;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ask employees to pay for their own worker&#8217;s compensation coverage;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Discriminate against workers who file or plan to file claims;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tell workers which healthcare provider they may go to unless they participate in a Preferred Provider Organization (PPO) or Alternate Dispute Resolution (ADR) program;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Discuss a worker\u2019s injury with their doctor; or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ask whether a potential hire has outstanding worker&#8217;s compensation claims.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Is an employer responsible for its employees\u2019 actions?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In some circumstances, an employer is <\/span><a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/employer-liability-employees-bad-acts-29638.html?pathUI=button\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">responsible for its employee\u2019s actions<\/span><\/a><span style=\"font-weight: 400;\"> even if the employee\u2019s actions were in violation of a policy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, let\u2019s say an employee stacks heavy boxes on a high shelf, in violation of company policy. If one of those boxes falls and hits a customer, the company is responsible for the customer\u2019s injuries.
