What is the Adult Survivors Act?
The new Adult Survivors Act allows adult sexual abuse survivors to file claims until the end of 2023, regardless of when the abuse occurred. The ASA also accelerates the trial timetable in these matters, so victims get their day in court sooner and defendants have less time to prepare.
How New York Defines “Sexual Abuse”
Sexual abuse, like all other kinds of abuse, comes in many forms. Sexual predators are very adept at using all these forms of abuse to get what they want and keep the victims silent. Some common forms of child sexual abuse include:
- Grooming: Sexual predators lay the groundwork for future abuse so gradually that most victims don’t realize what’s happening. Frequently, these situations involve no physical abuse, usually because the victim moves or the predator gets cold feet. But, the damage is done, and the damage is permanent.
- Inappropriate Photography: It’s illegal and disgusting to photograph anyone, especially a minor, for sexual gratification purposes. Most of these victims know nothing about the abuse until years later. Sexual predators are very good at hiding their tracks and burying the evidence.
- Sexual Contact: Since ancient times, people have used positions of power to force their sexual will upon less powerful people. These survivors often feel like they consented, so they’re so ashamed they don’t come forward. Abuse-of-power sexual relationships, regardless of the ages involved, always violate criminal and civil laws.
Coming to terms with abuse, and moving on from it, is a long and expensive process that survivors should never go through alone. We offer emotional support, and more. We connect survivors with experienced providers who know how to help these victims live their lives.
Responsible Parties
Sexual predators are individually responsible for sexual abuse, no ifs, ands, or buts. Usually, an enabler is involved as well. Far too many times, that enabler is an organization that turns a blind eye to sexual abuse.
In individual abuse claims, a New York adult abuse survivor lawyer must prove the predator intentionally abused the victim. Basically, in civil court, “intentionally” means “non-accidentally.” The extreme conduct in sexual abuse cases is almost never accidental. These people know exactly what they’re doing, and why they’re doing it.
Organizations are financially responsible for abuse if they fail to protect people. This failure usually involves negligent hiring or negligent supervision. Negligent hiring is bringing an employee into the fold without asking the right questions. Negligent supervision is usually a failure to take allegations seriously or sweeping such matters under the rug.
In either case, compensation usually includes money for economic losses, such as therapy costs, and noneconomic losses, such as pain and suffering.
